Booking Contract

This is a legally binding contract between you (the client) and Stewart Clarke (the photographer). The purpose of this contract is to secure the given date with payment of a non-refundable booking fee.

Special features of this digital contract include a timestamp date-code and a 32 digit randomly generated code, for the purpose of authenticity and accountability.

Terms and Conditions
The photographer (Stewart Clarke) agrees that every effort will be made to provide a high quality photographic service. In the unlikely event of unforeseen circumstances such as mechanical failure to the photographer's equipment, transport to the venue, traffic delays or that the photographer is unable to provide client with the agreed photographic services and/or products, the photographer agrees to reimburse the client all amounts paid. The client agrees that the photographer is not responsible for any other damages, emotional or otherwise and that no compensation against the photographer can be made. In the event that the photographer cannot attend due to illness or any unavoidable personal circumstances, every effort will be made to find a suitable qualified replacement through a professional photographic society, although its success cannot be guaranteed.

Weather permitting, all photographs will be taken as agreed. In the event of weather disturbances, the photographer will make the changes necessary and will not be held responsible for any disappointment caused by the weather or venue limitations. In low-light situations or areas where the photographer is unable to use flash, photographs may appear 'grainy' due to a higher ISO speed being implemented to compensate for such situations. The photographer will do his best to avoid such situations but it may happen in some cases where light is limited and/or flash prohibited.

In the unlikely event that all or some of the photographs fail to materialise or if there is a total photographic failure due to reasons beyond control, the liability of the photographer will be limited to the refund of all monies paid. Neither party shall be liable for indirect or consequential loss.

The client understands that full payment must be paid no less than 14 days before the wedding. Failure to do so could result in the photographer not attending the wedding.

To ensure that photographs are of a consistently high standard, the photographer cannot be responsible for unusable shots due to distractions or interruptions from guests, contractors (entertainers, video operators etc.), or other circumstances beyond the photographer's control.

The photographer reserve the right to use any of the images taken on the wedding day for advertising purposes, i.e. exhibitions, display albums, literature and website.

Cancellation Policy
If a Wedding Photography booking has to be cancelled, it is the sole responsibility of the client to notify and ensure that Stewart Clarke Photography has received the instruction in writing. The appropriate cancellation fees will apply as follows:

The Initial £100 booking fee is non-refundable
8 weeks notice of cancellation 50% of remaining final package cost
2 weeks notice of cancellation 100% of final package cost

Stewart Clarke Photography may have to make changes for reasons of Force Majeure, meaning unusual or unforeseeable circumstances beyond his control, the consequence of which neither his suppliers nor he could avoid.  For example, industrial disputes, natural disasters, fire or adverse weather conditions or similar events beyond his control.  Under these circumstances, Stewart Clarke Photography will endeavor to reschedule or source an alternative photographer or supplier.
